Pennsylvania
Brain Injury Laws

A comprehensive guide to the laws that govern brain injury claims in Pennsylvania, including workers' compensation, personal injury statutes, and recent court decisions.

Pennsylvania Workers' Compensation Laws

Pennsylvania's Workers' Compensation Act (77 P.S. § 1 et seq.) provides benefits to employees injured in the course of employment, regardless of fault. For brain injuries, this includes:

Medical Benefits

Employers must pay for ALL reasonable and necessary medical treatment related to your brain injury. This includes hospitalization, rehabilitation, neuropsychological testing, therapy, medications, and future medical care. There is NO cap on medical benefits.

Wage Loss Benefits

If your brain injury prevents you from working, you're entitled to:

  • Total Disability: 2/3 of your average weekly wage (up to the state maximum of $1,325/week in 2026)
  • Partial Disability: 2/3 of the difference between your pre and post-injury wages
  • Duration: Up to 500 weeks for partial disability; total disability can continue indefinitely

Specific Loss Benefits

Pennsylvania provides additional compensation for permanent impairment to body parts or functions, including cognitive function affected by brain injury. These benefits are in ADDITION to wage loss benefits.

Personal Injury Law for Brain Injuries

When a third party (someone other than your employer) causes your brain injury, you may have a personal injury claim in addition to workers' compensation. This allows you to recover damages not available through workers' comp.

Recoverable Damages in Personal Injury

  • • Past and future medical expenses
  • • Full lost wages (not just 2/3)
  • • Loss of future earning capacity
  • • Pain and suffering
  • • Loss of enjoyment of life
  • • Loss of consortium

Third Parties Who May Be Liable

  • • Equipment manufacturers
  • • Property owners
  • • Subcontractors on job sites
  • • Negligent drivers
  • • Architects and engineers
  • • Safety equipment manufacturers

Statute of Limitations

Critical Warning:Missing these deadlines can permanently bar your claim. Contact an attorney immediately if you've been injured.

Workers' Compensation

  • Report injury: Within 120 days (but report immediately for best results)
  • File claim petition: Within 3 years of injury date
  • Discovery rule: May extend deadline if injury wasn't immediately apparent

Personal Injury

  • General rule: 2 years from date of injury
  • Discovery rule: 2 years from when you knew or should have known of injury
  • Minors: Deadline may be extended until age 20

Damage Caps & Limits

Good News: Pennsylvania does NOT have caps on personal injury damages. You can recover the full value of your brain injury claim.

Workers' Comp Wage Limits

While there's no cap on total workers' comp benefits, wage replacement is limited to 2/3 of your pre-injury wages, up to the state maximum (currently $1,325/week).

No Cap on Personal Injury

Pennsylvania has NO caps on compensatory damages in personal injury cases. Brain injury victims can recover the full value of their pain, suffering, and losses.

Punitive Damages

Available in cases of gross negligence or intentional misconduct. While not capped, punitive damages must be proportional to compensatory damages.

Comparative Negligence in Pennsylvania

Pennsylvania follows a "modified comparative negligence" rule for personal injury cases. This affects your recovery if you share some fault for your brain injury.

51% Bar Rule

You can recover damages as long as you are NOT more than 50% at fault for your injury. However, your recovery is reduced by your percentage of fault.

Example:If your brain injury claim is worth $1,000,000 but you're found 20% at fault, you would recover $800,000.

Note: Workers' compensation is NO-FAULT. Comparative negligence does not apply to your workers' comp claim—only to third-party personal injury claims.
